Only first-time offenders are newly eligible under the law change for expungement in Michigan. Specific criminal convictions that may be expunged now include: Driving with a blood alcohol content at or above 0.08; Driving while visibly impaired due to any substance; Anyone who is younger than 21 driving with a blood alcohol content of 0.02 or higher; Driving under the influence of any amount of cocaine or other schedule 1 controlled substances. There appears to be no limitation if convicted of Michigan Super Drunk or High BAC which would be at or above 0.17. While this offense may be more challenging, nothing in the law says this offense is excluded for consideration. Comments are closed.
